1. Introduction and Acceptance

Welcome to VideoCome ("we", "us", "our", or the "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you and VideoCome governing your access to and use of our watermark removal service. By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using our Service.

2. Eligibility

You must be at least 18 years of age to use our Service. By using our Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are using our Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Service Description

VideoCome provides an automated service for removing watermarks from video files. Our Service processes video files uploaded by users and returns processed versions with watermarks removed. The Service is provided on an "as is" and "as available" basis without any guarantees regarding quality, speed, or results.

4. Account Registration and Security

To access certain features of our Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information;
  • Maintain the security and confidentiality of your account credentials;
  • Immediately notify us of any unauthorized access or security breach;
  • Accept full responsibility for all activities that occur under your account.

You are solely responsible for any losses or damages resulting from your failure to maintain account security. We are not liable for any loss or damage arising from unauthorized access to your account.

5. User Content and Intellectual Property Rights

Your Ownership:

You retain all ownership rights to the videos and content you upload to our Service ("User Content").

License Grant:

By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to access, store, process, and transmit your User Content solely for the purpose of providing the watermark removal service.

Your Representations and Warranties:

You represent and warrant that:

  • You own all rights to the User Content or have obtained all necessary permissions, licenses, consents, and rights to upload and process the User Content;
  • Your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or any other rights;
  • Your use of the Service complies with all applicable laws, regulations, and these Terms;
  • You have the legal right to remove watermarks from the content you upload.

⚠️ CRITICAL WARNING:

Removing watermarks from copyrighted content without authorization may violate intellectual property laws, including copyright law, in your jurisdiction. You are solely responsible for ensuring you have the legal right to modify and use any content you process through our Service.

6. Prohibited Uses and Restrictions

You agree NOT to use our Service to:

  • Violate any applicable local, state, national, or international law or regulation;
  • Infringe upon or violate the intellectual property rights or any other rights of any third party;
  • Process content that you do not have the legal right to modify or use;
  • Remove watermarks from copyrighted material without proper authorization from the copyright holder;
  • Upload or transmit viruses, malware, or any other malicious code;
  • Engage in any conduct that restricts or inhibits anyone's use of the Service;
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service;
  • Use any automated system (bots, scrapers, etc.) to access the Service without our express written permission;
  • Upload content containing illegal material, child exploitation material, or content promoting violence, hate, or discrimination;
  • Use the Service for any fraudulent, deceptive, or unlawful purpose;
  • Resell, redistribute, or commercially exploit the Service without authorization.

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing User Content, terminating accounts, and reporting violations to law enforcement authorities.

7. Payment Terms and Fees

Fees:

Certain features of our Service may require payment. All fees are stated in US dollars unless otherwise specified and are non-refundable except as expressly provided in Section 8.

Payment Processing:

Payments are processed through third-party payment providers. By making a payment, you agree to the terms and conditions of our payment processors. We do not store or have access to your payment card information.

Billing:

You authorize us to charge your payment method for all fees incurred. You are responsible for all charges incurred under your account, including applicable taxes.

Price Changes:

We reserve the right to modify our pricing at any time. Price changes will not affect existing subscriptions until renewal.

8. Refund Policy

7-Day Refund Window:

Refund requests must be submitted within seven (7) days of purchase by contacting support@videocomm.com. After 7 days, all purchases are final and non-refundable.

Refund Eligibility:

Refunds may be granted at our sole discretion if:

  • The Service failed to perform as described due to technical issues on our end;
  • You did not use or access the Service after purchase;
  • There was an unauthorized or fraudulent charge.

No Refunds For:

Refunds will not be provided for dissatisfaction with results, change of mind, misuse of the Service, violation of Terms, or after you have extensively used the Service.

Refund Process:

Approved refunds will be processed to the original payment method within 10-14 business days.

9. Service Modifications and Availability

We reserve the right to modify, suspend, discontinue, or restrict access to all or any part of the Service at any time, with or without notice, for any reason, including but not limited to:

  • Maintenance, updates, or technical improvements;
  • Changes in business strategy or economic viability;
  • Legal, regulatory, or compliance requirements;
  • Security concerns or technical limitations;
  • Third-party service disruptions or dependencies.

We do not guarantee continuous, uninterrupted, or secure access to the Service. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

10. Content Processing and Data Deletion

Processing:

When you upload videos to our Service, they are temporarily stored on our servers for processing purposes only.

Automatic Deletion:

All uploaded and processed videos are automatically deleted from our servers within 24-48 hours after processing is complete. You are responsible for downloading your processed files within this timeframe.

No Backup or Recovery:

We do not maintain backups of User Content. Once deleted, files cannot be recovered. We are not responsible for any loss of User Content.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT;
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, QUALITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE;
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
  • WARRANTIES REGARDING THE QUALITY OR RESULTS OF WATERMARK REMOVAL.

YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOCOMM, ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE;
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR USER CONTENT;
  • DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF THIRD PARTIES;
  • DAMAGES RESULTING FROM DELETION, CORRUPTION, OR LOSS OF USER CONTENT;
  • DAMAGES ARISING FROM COPYRIGHT INFRINGEMENT CLAIMS OR LEGAL ACTIONS RELATED TO YOUR USER CONTENT;
  • DAMAGES RESULTING FROM SERVICE INTERRUPTIONS, MODIFICATIONS, OR DISCONTINUATION.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless VideoCome, its owners, operators, affiliates, partners, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs) arising from or relating to:

  • Your use or misuse of the Service;
  • Your violation of these Terms;
  • Your violation of any rights of any third party, including intellectual property rights;
  • Your User Content, including any copyright infringement claims;
  • Any claim that your User Content caused damage to a third party;
  • Your violation of any applicable laws or regulations.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

14. Copyright Infringement and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe that your copyrighted work has been infringed through our Service, please provide us with written notice containing:

  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing;
  • Your contact information (address, telephone number, email);
  • A statement that you have a good faith belief that use of the material is not authorized;
  • A statement that the information in the notification is accurate;
  • Your physical or electronic signature.

We may terminate accounts of repeat infringers. However, you acknowledge that we are not liable for User Content uploaded by third parties and that any legal action should be directed at the user who uploaded infringing content.

15. Termination

Termination by You:

You may terminate your account at any time by contacting us at support@videocomm.com. Termination does not entitle you to any refund except as provided in Section 8.

Termination by Us:

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms;
  • Suspected fraudulent, abusive, or illegal activity;
  • Extended periods of inactivity;
  • Requests by law enforcement or other government agencies;
  • Discontinuation of the Service;
  • Unexpected technical or security issues;
  • Any conduct we deem harmful to the Service or other users.

Effect of Termination:

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction of such courts.

17. Dispute Resolution and Arbitration

Informal Resolution:

Before filing a claim, you agree to contact us at support@videocomm.com to attempt to resolve the dispute informally for at least 30 days.

Arbitration Agreement:

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver:

You agree that disputes will be resolved on an individual basis only, and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page, unless otherwise specified. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. We will make reasonable efforts to notify users of material changes via email or prominent notice on the Service. You are responsible for reviewing these Terms periodically.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of VideoCome.

21. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms, in whole or in part, without our prior written consent. We may assign or transfer these Terms or any rights or obligations under these Terms at any time without restriction and without notice to you.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and VideoCome regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.

23. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
